If you are called before a supervisor for an interview concerning a matter of alleged misconduct, you should always request the presence of a San Antonio Professional Firefighters Association representative or an attorney before you answer any questions. If your request is denied, document such refusal. If you are ordered to write a statement, your report (or answers to specific written questions) should begin with: “This report is made by me after being ordered to do so by lawful supervisory officers. It is my understanding that by refusing to obey an order to write this report that I can be disciplined for insubordination and the punishment for insubordination can be up to and including termination of employment. This report is made only pursuant to such orders and the potential punishment/discipline that can result for failure to obey that order. For any and all other purposes, I hereby reserve my constitutional right to remain silent under the 5th and 14th Amendment to the U.S. Constitution and all other rights prescribed and to which I am entitled by law.” To download this file in Adobe Acrobat, click here.
